Naturalization is the process through which someone with permanent residency is granted U.S. citizenship after they satisfy certain requirements.
To be eligible for naturalization based on being a lawful permanent resident for at least five years, you must:
(1) Be at least 18 years old when you submit Form N-400, Application for Naturalization;
(2) Show you have been a lawfully admitted permanent resident of the United States for at least five years;
Please note that at the time of the naturalization interview, USCIS may inquire and investigate as to how you became a permanent resident.
(3) Demonstrate continuous residence in the United States for at least five years immediately before the date you file Form N-400;
To become naturalized, you must prove continuous residence in the United States for five years. This particular requirement can be quite confusing. To meet this condition, you must demonstrate that you haven't had any extended periods of absence from the country.
It does not mean that you cannot travel onside the country, but you have to be careful how much time you spend outside the US,
Remaining outside of the USA for longer than 6 months at a time will break the continuity of this requirement and you may be required to provide some evidence in your defense that you actually have not broken this rule. it could be documents showing your trips were connected to your employment.
If you stay onside USA longer than 1 year, this will certainly mean that you have broken the continuity of residence. You will not be able to provide evidence and the 5-year period will have to start over.
(4) Show you have been physically present in the United States for at least 30 months out of the five years immediately before the date you file Form N-400;
An applicant for naturalization is generally required to have been physically present in the United States for at least half the time for which his or her continuous residence is required. To satisfy this requirement, you must show that you have been physically present inside the United States for at least 30 months (2.5 years) over the last 5 years.
(5) Show you have lived for at least three months in a state;
You must have been residing in the state or service district, that you will apply for naturalizing in, for at least 3 months before filing your application for naturalization.
(6) Show that you are a person of good moral character and have been a person of good moral character for at least five years immediately before the date you file Form N-400;
To qualify for this requirement, you need to demonstrate that you have maintained good moral character during the five years leading up to your naturalization application. USCIS evaluates this requirement by considering various factors, such as any past criminal convictions, your drinking habits, and your history of tax payments, among others.
Some factors that could show lack of good moral character:
(7) Demonstrate an attachment to the principles and ideals of the U.S. Constitution;
(8) Be able to read, write and speak basic English;
You must demonstrate that you understand the English language by performing an English proficiency test. You will be required to do this during the Naturalization interview, which is a part of the Naturalization process.
Certain applicants, because of their age and time as an LPR, do not have to take the English test for naturalization and may take the civics test in the language of their choice.
(9) Have knowledge and understanding of the fundamentals of the history, and of the principles and form of government, of the United States, (civics); and
(10) Take an Oath of Allegiance to the United States.
