Treaty Trader (E-1), Treaty Investor (E-2), and Australian in Specialty Occupation (E-3) nonimmigrant visas may be issued to elegible nationals of countries with which the United States maintains Bilateral contracts. 

E-1 Treaty Trader 

• Purpose: Engage in substantial international exchange of goods, services, and technology principally between the United States and the treaty country.

• Requirements: Develop and direct the operations of the enterprise. Must be a national of a treaty country with clear intention to depart the U.S. when the E-1 status expires. 

• Duration of stay in the USA: Maximum initial stay of two years. Extensions may be granted.  

E-2 Treaty Investor 

• Purpose: Allows the Investor to enter and work in the U.S. based on their investment. The investment must be in an active business as opposed to passive investments like stocks or undeveloped land. The investor must develop and direct the enterprise.

• Requirements: The investor must make a substantial investment in a bona fide enterprise in the U.S. There's no specific minimum dollar amount defined, but the investment must be significant relative to the total cost of purchasing or creating the enterprise.

• Duration of stay in the USA: Maximum initial stay of two years but can be renewed indefinitely as long as the business operates.

E-3 Specialty Occupation Workers from Australia

• Purpose: Applies only to nationals of Australia who are coming to the United States solely to perform services in a specialty occupation.

• Requirements: Have a legitimate offer of employment in the United States, possess the necessary academic or other qualifying credentials, will fill a position that qualifies as a specialty occupation.

• Duration of stay in the USA: Up to 2 years, posible extension. 

Special Considerations

Spouses and unmarried children under 21 years of age can accompany the primary visa holder, usually receiving derivative status, which may allow them to study and, in some cases, work in the U.S.

Each of these visas requires detailed documentation and strict adherence with U.S. immigration policy. The paperwork cause major delays and confusion to most people.
