Adjustment of Status in the USA

Adjustment of Status (AOS) allows a nonimmigrant visa or status holder who is in the United States to apply for and obtain lawful immigrant status (a Green Card) without having to leave the country.

To  request an Adjustment of Status, a specific application form (Form I-485, Application to Register Permanent Residence or Adjust Status) must be mailed to USCIS along with any required supporting documents and fees.

To qualify for AOS, an applicant must:

• be lawfully presented in the U.S. on a valid nonimmigrant status, 
• have an approved immigrant petition (such as for family or employment), 
• and have an available visa number.

If the application is approved, a green card will be granted, giving the applicant permanent resident status.
